When you want to build a fence the best place to start your research is to contact the local building code enforcement department at city where you live. All North Texas Cities have building codes that affect fences and you should make sure that you know what is and what is not permitted in your city. If you live in a community where there is a Home Owners Association the next thing you should do is check your HOA documents, or contact the HOA directly, and determine what restrictions, if any, are placed on your ability to build a fence. While HOA restrictions can not give you permissions to override the City ordinances, the HOA can add additional restrictions above and beyond what the City restriction address.The main things that both City and HOA restrictions address are things like:Fence HeightFence Materials required or permittedSet-Back from property lines and from streetsVariance ProceduresIt is not uncommon for property owners to apply for and receive special variances from the City building codes for special situations. The proper procedures for applying for such variances are covered in most City ordinances, but if you simply call the building code department the people there will be able to tell you how to apply for and process a variance request.Once you have determined what kind of fence you can build you will need to apply for a building permit from the city. While it is true that many fences are constructed without a building permit doing so opens you to enforcement problems if you find that a neighbor gets upset or if you happen to be spotted by a building code inspector who is driving through the area while you are building the fence. Fines can be imposed and you should avoid the related problems by simply applying for a building permit.
