Easements must be considered when designing a fence. An easement is a property use agreement that supersedes the property owners rights. Easements are avenues of access that must be granted to persons other than the property owner and which give those persons the right to enter or traverse the property at their will for a variety of purposes. Fences can not be constructed that interfere with the rights of the easement owner (as opposed to the property owner). The easement owner may be a utility company that has a statutory right to cross the property to maintain and service public utilities such as water, gas, or electric power easements. Easements may be granted to private parties such as the owners of a land-locked property which needs access to roads and has a right of easement to cross a property to get to a road.Boundary lines must also be considered as they are the lines that mark the edge of your property. In urban areas where properties a clearly defined and everyone has a relatively current survey boundary lines are not difficult to ascertain. In rural areas, especially when the properties have been in families for generations without recent surveys, boundary lines may be less obvious. Most areas have a rule about set-back of fencing from the boundary line. If you want to build a fence but your neighbor does not want a fence you must build your fence according to the setback rules. That means that you may have to place your fence anywhere from six (6) inches to six feet from the boundary line. This means that you are enclosing dramatically less space than you own. If your neighbor agrees to build a boundary line fence then both you and your neighbor can share in the cost and the maintenance of the boundary line fence and you can place it directly on the boundary line giving both you and your neighbor more enclosed space.Texas State Fence Co. has been building boundary line fences for over 15 years and is familiar with all of the local rules regarding set-back requirements.
